Vu la communication faite au procureur général ;
LA COUR, en l'audience publique du 5 juillet 2017, où étaient présents : Mme Flise, président, Mme X..., conseiller rapporteur, M. Liénard, conseiller doyen, Mme Y..., avocat général, Mme Molle-de Hédouville, greffier de chambre ;
Sur le rapport de Mme X..., conseiller, les observations de la SCP Masse-Dessen, Thouvenin et Coudray, avocat de la société EDF, l'avis de Mme Y..., avocat général, et après en avoir délibéré conformément à la loi ;
Sur la recevabilité du pourvoi relevée d'office après avis donné aux parties en application de l'article 1015 du code de procédure civile :
Vu les articles 524 et 525-2 du code de procédure civile ;
Attendu, selon l'ordonnance attaquée rendue par un premier président (Saint-Denis de La Réunion, 10 mai 2016), que la société EDF, ayant sollicité, sur le fondement de l'article 524 du code de procédure civile l'arrêt de l'exécution provisoire assortissant à hauteur de leur moitié les condamnations prononcées à son encontre au profit d'un certain nombre de sociétés par un jugement dont elle a interjeté appel, a formé un pourvoi contre l'ordonnance du premier président, statuant en référé, ayant déclaré sa demande irrecevable ;
Mais attendu que lorsqu'il est saisi en application de l'article 524 du code de procédure civile, le premier président statue en référé par une décision non susceptible de pourvoi ;
D'où il suit que le pourvoi n'est pas recevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi ;
Condamne la société EDF aux dépens ;
Vu l'article 700 du code de procédure civile, rejette la demande de la société EDF ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du vingt-huit septembre deux mille dix-sept.
